Hazelwood Parish Council is aware that Derbyshire County Council is currently undertaking a consultation regarding an application affecting Lumb Lane.
The application, originally submitted in 2004, seeks to upgrade an existing public bridleway and adjoining non-classified highway to Byway Open to All Traffic (BOAT) status.
Derbyshire County Council is responsible for investigating the application and determining whether the legal test for any modification to the Definitive Map has been met.
The current consultation is an initial evidence-gathering exercise. No decision has been made on the application.
The purpose of the consultation is to allow anyone with relevant evidence or information, whether in support of or opposed to the claim, to submit it for consideration.
Following the consultation period, Derbyshire County Council will review all evidence received and prepare a report with a recommendation.
Any decision must be based on the available evidence relating to highway rights.
Should the application progress, there would be a further formal consultation and objection process before any change could take effect.
Equally, if the evidence is found to be insufficient, the application may be refused.
Residents wishing to comment or submit evidence should do so directly to Derbyshire County Council in accordance with the consultation information they have received.
Hazelwood Parish Council has not adopted a position on the application and will continue to monitor the process.
